Terms of Service

These Terms of Service govern your use of Plantory, a digital service for garden planning, AI recommendations, plant identification, visualizations, and related features. By using the service, you confirm that you have reviewed and accepted these terms.

1. Acceptance of Terms

By using Plantory, you enter into a contractual relationship with the operator to the extent relevant to the features you use. If you use the service on behalf of a business or another person, you confirm that you are authorized to bind that person. If you do not agree, do not use the service.

3. Description and Nature of the Service

Plantory is a digital service that may include, in particular:

  • Interactive garden design and planning tools.
  • Plant database features, plant identification, and enrichment from external sources.
  • AI chat, recommendations, task planning, and planting plans.
  • Garden visualizations and work with photos, map layers, and uploaded files.
  • Organization, sharing, and collaboration features.
  • Paid plans with different scopes of features and usage limits.

The service is continuously developed. We may modify, restrict, suspend, or discontinue the service or any part of it, including specific features, integrations, and pricing plans. We do not commit to uninterrupted availability of any specific feature unless applicable law requires otherwise.

4. Accounts and Access

Registration

You must provide accurate, complete, and up-to-date information when registering. You are responsible for ensuring that your account is not used in violation of law, these terms, or third-party rights.

Organizations and Team Accounts

If you create an organization or invite members, you are responsible for managing access, roles, and permissions. The organization, its owner, or its administrator is responsible for the actions of users who are granted access.

Account Security

You must safeguard your login credentials and promptly notify us of unauthorized access, credential loss, or suspected abuse. To the extent permitted by law, we are not liable for damage resulting from your failure to protect access credentials.

5. Important AI Limitations

Plantory uses algorithmic and AI-generated outputs based on user inputs, statistical models, and available external sources. Those outputs have significant limitations.

Informational Purpose Only

AI outputs, recommendations, identifications, planting plans, chat responses, and visualizations are provided for general informational and workflow support purposes only. They are not professional gardening, biological, legal, safety, construction, or veterinary advice.

No Warranty of Outcome

We do not guarantee the accuracy, completeness, timeliness, legal suitability, or fitness of AI outputs for your specific circumstances. We do not guarantee yield, growth, plant survival, safety for persons or animals, site compatibility, or compliance with local rules.

Verification Is Required

Before acting on AI outputs, you must independently verify in particular:

  • Plant safety and toxicity for humans, children, and animals.
  • Suitability for local climate, soil, microclimate, and water conditions.
  • Local legal restrictions, invasive species rules, and other regulatory requirements.
  • Construction or technical risks where the output relates to land or structural changes.
  • The accuracy of plant, disease, or pest identification before taking action.

Use at Your Own Risk

You use AI outputs at your own risk. To the maximum extent permitted by law, we are not liable for crop failure, plant damage, data loss, economic loss, property damage, personal injury caused by misuse of outputs, or other consequences resulting from reliance on AI recommendations.

6. User Content

Ownership

You retain your rights in content that you upload to or create in Plantory, unless the rights belong to someone else by law. You are responsible for ensuring that you are entitled to use the content and that its use in the service does not infringe third-party rights.

License Needed to Operate the Service

By uploading content, you grant us a non-exclusive right to host, store, process, back up, display, transmit, and technically modify that content to the extent necessary to provide, secure, and improve the service.

Prohibited Content

You may not upload content that:

  • Is unlawful or supports unlawful activity.
  • Infringes copyright, privacy, personality, or other third-party rights.
  • Contains malware, malicious code, or mechanisms designed to bypass security.
  • Contains personal data of third parties disclosed without authorization.
  • Is manifestly fraudulent, abusive, or intended to misuse the service.

7. Subscriptions, Trials, and Consumer Rights

Plans and Pricing

Plantory may offer free and paid plans. Feature scope, usage limits, billing periods, and pricing are shown on the Pricing page or in checkout. We may change plans and pricing in the future.

Trial

Where a trial is offered, it starts only after the relevant checkout is completed. A trial may convert into a paid subscription when it ends unless you cancel it in time. The end date of the trial and related details are shown in the app or in checkout.

Billing and Auto-Renewal

Paid subscriptions are billed in advance for the selected billing period and generally renew automatically until cancelled. Payment processing is handled by Stripe. Taxes, currency conversion, or other mandatory charges may be calculated in checkout.

Cancellation

You may cancel a subscription from your account settings or available billing interface. Cancellation generally prevents future renewals; the already-paid period usually continues until its end unless applicable law provides otherwise.

Refunds

We do not provide a contractual right to refunds beyond what the law requires. Any voluntary refund issued by us is entirely discretionary and does not create precedent for future cases.

Mandatory Consumer Rights

If you are a consumer, nothing in these terms limits mandatory rights under Czech or other applicable law, including rights relating to defective digital services, pre-contract information duties, or other protections that cannot be waived.

Withdrawal Rights

If you are a consumer and the contract is concluded at a distance, you may have a statutory right to withdraw. Where digital service delivery begins before the withdrawal period expires, the consequences of withdrawal are governed by applicable law and by the actual checkout and service setup in place when the contract is concluded.

Complaints and Defects

If you want to report a defect or make a complaint about the digital service, contact support@plantory.ai and describe the issue as precisely as possible. We will handle complaints without undue delay and in accordance with applicable law.

Alternative Dispute Resolution for Consumers

The competent alternative dispute resolution body for consumer disputes is the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, Czech Republic, www.coi.gov.cz, adr.coi.gov.cz.

8. Acceptable Use

You must not use the service in a way that violates law, these terms, or the technical limits of the service. In particular, you may not:

  • Bypass security, access controls, or usage limits.
  • Perform scraping, automated extraction, or other unauthorized collection of data.
  • Attempt to access other users' accounts, organizations, or data.
  • Reverse engineer, decompile, or attempt to extract source code except where the law expressly allows it.
  • Use the service to spread spam, malicious content, or fraudulent schemes.
  • Resell, sublicense, or commercially redistribute the service without our express permission.
  • Upload content for which you do not have the necessary rights.

9. Suspension and Termination

Termination by You

You may stop using the service at any time and may cancel or delete your account where that functionality is available. Cancelling an account or subscription does not itself affect already accrued payment obligations or duties that are intended to survive termination.

Termination or Restriction by Us

We may suspend or restrict access without prior notice where necessary for security, abuse prevention, breach handling, unpaid charges, force majeure, or to protect the service and other users. Where circumstances allow, we will provide reasonable notice.

Effect of Termination

Upon termination, your right to use the service ends to the extent of the terminated access. Provisions that by their nature should survive termination remain in effect, including provisions on fees, liability, content rights, disputes, and protection of rights.

10. Warranties and Limitation of Liability

No Contractual Warranties

To the maximum extent permitted by law, Plantory is provided on an "as is" and "as available" basis. We do not provide contractual warranties of uninterrupted availability, error-free operation, compatibility, fitness for a particular purpose, specific outcomes, or conformity with your individual expectations.

Exclusion of Indirect Damages

To the maximum extent permitted by law, we are not liable for loss of profit, loss of business opportunity, loss of expected savings, loss of data, reputational harm, or any indirect, consequential, incidental, or similar damages, including damages caused by failures of third-party networks, cloud providers, payment providers, AI services, or external data sources.

Liability Cap

If you are acting as a business customer, our total aggregate liability for all claims related to the service will not exceed the amount you actually paid to us during the 12 months preceding the event giving rise to the claim. For free use and for consumers, this limitation applies only to the extent permitted by law.

Mandatory Consumer Rights

Nothing in these terms excludes or limits liability that cannot be excluded under applicable law, nor does it limit mandatory consumer rights, including rights relating to defective digital services or other non-waivable remedies.

Rules for Business Users

If you use the service in the course of business, you acknowledge that Plantory is standardized software and is not tailored to your internal workflows, compliance obligations, or security requirements. You are responsible for assessing its suitability for your own use case.

11. Indemnification and Recourse

If you are acting as a business customer, you agree to indemnify us for losses, costs, and third-party claims arising from your unlawful use of the service, your breach of these terms, or your infringement of third-party rights. For consumers, this clause applies only to the extent permitted by law.

12. Changes to These Terms

We may amend these terms where reasonably required by product changes, pricing changes, legal requirements, technical service model changes, or changes in how we operate the business. The current version is published on the website. For material changes affecting a paid relationship, we may also use in-app notices or email where appropriate.

13. Governing Law and Dispute Resolution

These terms and the legal relationship between you and the operator are governed by the laws of the Czech Republic.

If you are a consumer, mandatory provisions of the law applicable to you remain unaffected to the extent they cannot be contractually excluded.

If you are acting as a business customer, disputes will be resolved by the courts of the Czech Republic; local venue will be determined by the operator's registered address where permitted by law.

14. Severability

If any provision is invalid or unenforceable, the remainder of the terms remains effective. The invalid provision will be replaced by a legally permissible interpretation or provision that comes as close as possible to the original intent.

15. Entire Agreement and Language Version

These terms, together with the Privacy Policy, constitute the entire agreement between you and the operator concerning your use of Plantory.

If a Czech and an English version of these terms both exist and they conflict, the Czech version prevails unless applicable law or the nature of a specific relationship requires otherwise.
